This Privacy Policy explains how Herpenza Technologies Pvt Ltd ("we," "us," or "our") collects, uses, and protects your information when you use Hola AI, our AI-powered voicemail assistant. By using Hola AI, you agree to this Policy. If you do not agree, please discontinue use of the Service.

1.Who We Are

Hola AI turns missed calls into conversations. We record, transcribe, and summarize calls so you never miss what matters.

2.What We Collect

We collect only the data necessary to deliver and improve the Service.

a. Account Information

Name, email address, phone number, password, subscription and billing details.

b. Call & Voicemail Data

Caller numbers, timestamps, durations, recordings of forwarded calls, AI-generated transcripts, summaries, and optional labels.

c. Device & Usage Data

Device type, OS version, browser type, IP address, time zone, diagnostic logs, and analytics data.

d. Tracking & Analytics

Privacy-respecting tools (GA4, etc.). You can opt-out via settings. We do not use interest-based advertising.

3.How We Use Your Information

  • Provide and maintain Hola AI's call-handling, transcription, and summary features.
  • Send call summaries, alerts, and updates by email or SMS.
  • Detect spam and improve AI accuracy.
  • Support billing, troubleshooting, and customer service.
  • Comply with legal obligations and ensure security.

5.Messaging & Notifications

We use messaging providers to deliver summaries and alerts. We share only the data required for delivery. No mobile information is shared with third parties for marketing purposes. Text-messaging opt-in data and consent are never shared.

After a caller's conversation with the Hola AI agent ends, a single transactional SMS is sent to the caller's phone number to confirm their message has been forwarded. This SMS includes the recipient's name, the AI agent name, and a link to www.holavoicemail.com. Message frequency: one message per call. Message and data rates may apply. Reply STOP to opt out. No mobile opt-in data or phone numbers collected through this SMS notification program will be shared with or sold to third parties or affiliates for marketing or promotional purposes at any time.

6.AI Processing & Sub-processors

To provide call answering, transcription, and summary features, Hola AI sends certain user data to the following third-party AI services:

Data protection commitments:

  • All sub-processors are bound by Data Processing Agreements (DPAs) that require equivalent or greater data protection standards.
  • Data sent to these providers is encrypted in transit (TLS 1.2+) and at rest (AES-256).
  • Sub-processors are prohibited from using your data to train their own AI models.
  • We regularly review sub-processor compliance and security practices.

User consent:

Users are required to provide explicit consent within the Hola AI app before any call data is shared with these providers. Consent can be withdrawn at any time through the app's Privacy settings, which will disable AI-powered features.

7.Third-Party Data Protection

We ensure that any third party with whom we share personal data provides the same or equal level of protection of personal data as set out in this Privacy Policy. Our agreements with sub-processors include:

  • Obligations to process data only as instructed by Hola AI
  • Requirements to implement appropriate technical and organizational security measures
  • Restrictions on using data for any purpose other than providing services to Hola AI
  • Obligations to delete or return data upon termination of the agreement
  • Commitments not to use personal data for model training or improvement
  • Regular security audits and compliance reviews

If we determine that a sub-processor can no longer meet these obligations, we will take steps to stop the transfer and processing of personal data by that sub-processor.

8.Call Recording Consent & Caller Notice

Hola AI records forwarded calls to generate transcripts and summaries. Call-recording laws differ by jurisdiction. You are responsible for ensuring required consent from callers. Hola AI provides tools such as optional pre-call disclosure greetings to help you comply.

9.Data Storage & Security

  • Stored on AWS servers in the United States.
  • Encrypted in transit and at rest (TLS + AES-256).
  • Access restricted to authorized personnel.

If a data incident occurs, we will notify affected users and regulators in accordance with law.

11.International Transfers & Safeguards

Data may be processed in the United States and India. Where required, we apply Standard Contractual Clauses (SCCs) and other adequate safeguards to protect your information.

13.User Rights

You may:

  • Access, rectify, or delete your data.
  • Export your data in a portable format.
  • Withdraw consent for processing.
  • Lodge a complaint with your data-protection authority.
